Deferred Action for Childhood Arrivals (DACA)
What is DACA?
On June 15, 2012, the Secretary of Homeland Security announced that certain people who came to the United States as children and meet several guidelines may request consideration of deferred action for a period of 2 years, subject to renewal. They are also eligible to request work authorization. Deferred action is an exercise of prosecutorial discretion to defer removal action against an individual for a certain period of time. What steps should DREAMers and DACA students take at this time?
The U.S. Citizenship and Immigration Services (USCIS) is not accepting new DACA applications from people who have not been granted DACA previously. USCIS is still accepting DACA renewal applications, however, under the latest policy, but this may change based on the Fifth Circuit or U.S. Supreme Court decisions, discussed further below.
How to renew?
You should apply for a renewal of your , as early as possible.
- Requirements: Prior approval is required, payment for USCIS fees and the submission of 2 passport photos.
- Online Renewal: Total $555 ($470 for I-765 + $85 for I-821D)
- Paper Renewal: Total $605 ($520 for I-765 + $85 for I-821D)
